Terms of use
Last updated October 1, 2026
These terms cover your use of The Cake Wizard, run by Daft Planet Media LLC ("we", "us"). By using the site you agree to them. If you do not agree, please do not use the site.
1. What The Cake Wizard is
The Cake Wizard is a marketplace that introduces people who want a custom cake ("customers") to independent cake makers: home bakers and bakeries. We do not make, sell, inspect, store or deliver cakes. We are not a party to the agreement between a customer and a cake maker.
2. Cake makers are independent
Cake makers are independent businesses, not our employees, agents or partners. Each cake maker is solely responsible for their cakes, ingredients, kitchen, food safety, labeling, prices, quotes, delivery and customer service, and for holding any license, registration, permit, insurance or training that the law requires where they work. In the United States, cottage food laws vary by state and sometimes by county or city.
When a cake maker joins, they confirm to us that they follow the food and licensing rules that apply to them. We do not verify that confirmation, inspect kitchens or check licenses. Badges on a profile mean only what they say: "Email verified" means we confirmed the email address; "License number provided" means the cake maker gave us a number, which we do not check; "Member" means they pay for a membership.
3. Allergens and food safety
If you or your guests have a food allergy or a dietary need, tell your cake maker before you order and satisfy yourself that they can meet it. Dietary options shown on a profile or in a request (for example gluten-free, nut-free or vegan) are statements by the cake maker or the customer. We do not test them. Many kitchens, especially home kitchens, also handle common allergens such as nuts, wheat, milk, eggs and soy, and cross-contact can happen. We make no promise that any cake is free of any allergen or safe for any person.
4. Requests, quotes and orders
- A request is an invitation for cake makers to quote. It is not an order.
- A quote is the cake maker's offer. When a customer accepts a quote on the site, we share each party's contact details with the other. The order itself, including the final design, price, deposit, payment, pickup or delivery, changes and cancellation, is agreed between the customer and the cake maker.
- Sketches shown on the site are rough illustrations of size, shape and colors. They are not a promise of how a finished cake will look.
- We do not promise that any request will get a quote or that any cake maker is available in your area.
5. Paying for a cake
For now, customers pay cake makers directly, including any deposit. We do not collect, hold or refund money for cakes, and we are not responsible for payment disputes. Agree the price, the deposit and the cancellation terms with your cake maker before you pay.
6. Cake maker accounts: Free and Premium
- A free account costs nothing. It includes a basic public profile with a limited number of photos and specialties, and a cake maker's first lead in full. After that, opening and replying to leads may require a Premium account.
- A Premium account is currently $5 a month or $49 a year, billed in advance through Stripe and renewing until canceled. It includes every lead in the cake maker's area, the larger photo and specialty limits, links to their own website and Instagram, the Premium badge and a place ahead of free accounts. The current limits are shown on the For cake makers page.
- You can cancel any time from your dashboard. Premium runs to the end of the period already paid for, and the account then becomes a free account. Except where the law requires it, payments are not refunded.
- A Premium account gives access to leads. It does not guarantee any number of leads, quotes accepted or orders.
- We may change prices for future periods. We will tell Premium account holders by email before a change takes effect.
- You must give accurate information, keep your password safe, only post photos of your own work, and reply to customers honestly and politely.
- We may review, decline, hide or remove a profile, or close an account, if we believe these terms have been broken, the law is not being followed, or customers may be at risk.
7. What you must not do
- Post anything unlawful, hateful, sexually explicit, threatening or misleading.
- Send requests you do not mean, or spam cake makers or customers.
- Upload photos or text you do not have the right to use. A customer's inspiration photo is shared only so the cake maker understands the idea.
- Ask a cake maker to copy trademarked characters or logos without the right to do so. Cake makers decide what they can lawfully make.
- Copy the site's data in bulk, or try to break, overload or get around the site's security.
8. Your content
You keep the rights in what you post. You give us permission to store, show and send it as needed to run the site: for example showing a profile publicly, or sending a request and its photos to matched cake makers. We may remove content that breaks these terms.
9. No warranty
The site is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties about the site, about any cake maker or customer, or about any cake, including warranties of quality, safety, fitness for a purpose or legality.
10. Limit of our liability
To the fullest extent the law allows, we are not liable for any loss, illness, injury or damage arising from a cake, from dealings between customers and cake makers, or from use of the site, and in any case our total liability to you is limited to the greater of the membership fees you paid us in the twelve months before the claim or one hundred US dollars. Nothing in these terms limits liability that cannot be limited by law.
11. Disputes between customers and cake makers
If something goes wrong with an order, please take it up with the other party first. You may tell us about it at hello@thecakewizard.com, and we may hide a profile or close an account, but we are not obliged to settle disputes or pay compensation.
12. Other countries
The site can be used in many countries. You are responsible for following the laws where you live and work, including food, consumer and tax laws.
13. Changes and governing law
We may update these terms. The date at the top shows the latest version, and continuing to use the site means you accept it. These terms are governed by the laws of the State of Florida, USA, without regard to its conflict of law rules, and the courts in Pinellas County, Florida have jurisdiction, unless the law where you live gives you rights that cannot be changed by contract.
